No Automatic Suspension From DOT in PA DUI Cases

Some state DOTs or DMVs suspend your license immediately upon arrest for DUI. In these states, the police officer at the roadside, will take your license on the spot. Your car gets towed, and you are taken back to the police station for processing. You would then have to file an objection with the state DOT or DMV to get your driving privileges back.

Fortunately, this does not happen in Pennsylvania. You retain your driving privileges in a PA DUI arrest case unless or until you are proven guilty in a Pennsylvania court, or if your license is suspended administratively as part of the court or ARD (Accelerated Rehabilitative Disposition) process.
